Who is liable for the fire safety in my rental property?
How often should smoke alarms be tested in a rental property?
Fire safety standards don’t differentiate between rented and not rented. As such, the manufacturer’s guidelines usually state that the test button should be pressed monthly. AS 1851 6.4.2 requires a 6-monthly inspection, this can be carried out by the owner/occupier, and records don’t need to be kept. However, the fire company must then inspect the smoke alarm annually as per AS1851.6.4.2. Annual inspections are also required to check the smoke alarms meet the standard of performance (usually AS3786 and BCA Spec E2.2) in order to endorse the AFSS. This sits more within the realm of a tenancy legislation specialist, but in essence, the landlord must ensure that the rental is fit to live in, and a non-working smoke alarm would be considered an urgent repair.
What are the fire safety responsibilities of landlords?
Landlords have a duty of care to provide a safe environment. Again, you’d have to refer to a tenancy legislation specialist, but as a rule of thumb, the landlord needs to meet the minimum fire safety requirement for the building at the start of the tenancy agreement. If the tenant introduces an additional hazard (such as flammable materials) or requires additional fire safety for business-critical systems such as data centres, it would normally be the tenant who has the responsibility to maintain these.

What fire safety systems are required in rental properties?
They can vary depending on building use, size and age. Inside a residential unit (rented or not), there is normally a fire door and a smoke alarm. Sometimes, there are also fire containment measures such as fire collars around pipework, dampers in bathroom/kitchen extraction ducts and drenchers on windows. Can you provide a quote over the phone?
We generally price on a point rate. So, the number of extinguishers, detectors, fire doors, emergency lights, etc., that are required to be inspected, tested, maintained, repaired or certified will determine the price of the quote. We can provide a quote over the phone if we are given all this information and all the required standards and legislation we need to work on for the specific property. Alternatively, we can send someone to the site to provide obligation-free quotes. We often find we are not given all the information over the phone; therefore, there are variations once we get to the site. So, we prefer to come to the site. Note: Consultation and investigation work on site is chargeable.
